In a surprising revelation found in a family biography of Pappy Van Winkle, it was uncovered that Fitzgerald, who was previously thought to be a different man, was actually a bonded treasury agent. As the only ones legally allowed to hold the keys to the barrel storage rickhouses, Fitzgerald used his access to select the finest barrels of Bourbon, earning them the nickname "Fitzgerald barrels." This exquisite taste was later immortalized by Herbst and Pappy, who named the brand Old Fitzgerald. The story of Fitzgerald and Old Fitzgerald brand is steeped in legend. It is said that Fitzgerald built a distillery on the Kentucky River in the 1870s, where he sold his Bourbon to rail lines, steamships, and private clubs. The Old Fitzgerald brand was first registered in the 1880s by S.C. Herbst, and eventually found its way to Pappy Van Winkle during Prohibition.
